Terms of Service

1. Who we are and acceptance of these terms

Souqi (“we”, “us”) operates souqi.ps — a platform that lets merchants create and run their own online stores, and lets shoppers browse those stores and place orders. By creating an account, opening a store, or using any Souqi website, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the service.

2. The service

Souqi provides the technology to build and host online storefronts: product catalogs, order management, delivery settings, notifications, and related tools. Each store on Souqi is created, owned, and operated by an independent merchant. Souqi is not the seller of the products offered in merchant stores and is not a party to the sale between a merchant and a buyer.

3. Accounts

You must provide accurate information when creating an account and keep it up to date. You are responsible for keeping your login credentials secure and for all activity under your account. You must be legally capable of entering into a contract to open a store. Merchants may invite team members with different roles; the store owner remains responsible for their team's actions on the platform.

4. Merchant responsibilities

As a merchant you are solely responsible for your store: the products you list, their descriptions, prices, and photos, the legality of what you sell, fulfilling and delivering orders, handling returns and complaints, and complying with all laws that apply to your business, including consumer-protection and tax obligations.

You retain ownership of the content you upload. You grant Souqi a non-exclusive license to host, display, and process that content solely to provide the service — for example showing your products on your storefront and in order records.

5. Orders and payment

A sale concluded through a Souqi storefront is a contract between the buyer and the merchant. Payment is currently collected by the merchant on delivery (cash on delivery); any future online payment methods will be provided through third-party payment providers subject to their own terms. Souqi does not guarantee that a merchant will accept, fulfill, or deliver an order, nor the quality or safety of any product.

6. Acceptable use

You may not use Souqi to sell anything illegal, counterfeit, stolen, or dangerous; infringe intellectual-property or privacy rights; mislead or defraud buyers; send spam; interfere with or attempt to breach the security of the service; or use the platform's data outside the purpose of running your own store.

7. Fees

Creating and running a store on Souqi is currently free: no subscription, commission, or per-order fees. If we introduce paid features in the future (for example an optional shared marketplace), we will announce their pricing clearly before you opt in — we will not silently start charging you for what is free today.

8. Souqi's intellectual property

The Souqi platform — its software, design, brand, and documentation — belongs to Souqi. These terms give you no rights to it beyond using the service, and you may not copy, resell, or reverse-engineer it.

9. Third-party services

The service integrates with third parties such as WhatsApp links, advertising pixels (for example Meta and TikTok) that merchants may configure, and hosting and email providers. Your use of those services is governed by their own terms, and Souqi is not responsible for them.

10. Suspension and termination

You may close your account at any time. We may suspend or terminate a store or account that violates these terms, harms other users, or exposes Souqi to legal risk — where practical, we will warn you first. After termination we may delete store content following a reasonable grace period.

11. Disclaimers and limitation of liability

The service is provided “as is” and “as available”, without warranties of any kind, and we do not promise it will be uninterrupted or error-free. To the fullest extent permitted by law, Souqi is not liable for indirect damages or lost profits, and its total liability for any claim related to the service is limited to the amount you paid Souqi in the twelve months before the claim (currently zero for free accounts). Nothing in these terms excludes liability that cannot be excluded by law.

12. Changes to these terms

We may update these terms from time to time. For material changes we will give notice on the platform or by email before they take effect; continuing to use the service after that means you accept the new terms.

13. Governing law and contact

These terms are governed by the laws in force in the State of Palestine, and disputes are subject to the jurisdiction of the competent Palestinian courts. Questions? Contact us at support@souqi.ps.
